Art. 1 — Purpose of the Platform
LinkAF is a digital logistics platform operated by Afrilink Digital Group SAS. It provides two services: (1) a SaaS management tool for GP operators (independent collection-point operators) enabling parcel shipping, money transfers, multi-kiosk management and reporting; (2) a free consumer service allowing the African diaspora to track their parcels and money transfers in real time. Afrilink Digital Group provides the technological infrastructure and acts solely as a technical intermediary. It does not act as a carrier, freight forwarder, logistics operator, or payment service provider.
Art. 2 — Access to the Service
The consumer tracking service is freely accessible without account creation. Access to the GP operator management interface requires a paid subscription. Afrilink Digital Group reserves the right to modify, suspend, or terminate all or part of the service at any time, particularly for maintenance, security, or legal reasons, without prior notice or compensation.
Art. 3 — GP Operator Responsibility
GP operators are independent entrepreneurs who use the LinkAF SaaS platform to manage their logistics activities. Afrilink Digital Group is not a party to the contract between a GP operator and their customer. All claims relating to a parcel (loss, damage, delay, non-delivery) or a money transfer must be addressed directly to the GP operator. Afrilink Digital Group acts solely as a technology provider and technical intermediary.
Art. 4 — Strict Liability Disclaimer (Technical Intermediary)
Afrilink Digital Group acts exclusively as a technical intermediary within the meaning of the LCEN and the French Consumer Code. The platform cannot be held liable for: logistical delays attributable to carriers, freight forwarders or GP operators; loss, theft or damage to parcels caused by third-party carriers or logistics partners; inaccuracies in tracking data transmitted by third parties; temporary or total unavailability of the service due to server outages, maintenance, network failure, or force majeure. LinkAF is a tracking portal — not a transport or delivery service. The platform is provided "as-is".
Art. 5 — User & Operator Obligations
All users and GP operators agree to use the platform lawfully and in good faith. Prohibited: use for unlawful or fraudulent purposes; providing false registration information; attempting to bypass security measures or access data not intended for them; automated mass requests (scraping, bots) without prior written authorisation; any use constituting unfair competition or contravening applicable law.
Art. 6 — Subscriptions & Billing (GP Operators)
GP operator access is subject to a monthly subscription (Starter, Pro, or Enterprise plans) as published on the platform. Subscriptions renew monthly by tacit agreement and may be cancelled at any time from the management interface with effect from the end of the current period. Credits purchased are non-refundable once consumed.
Art. 7 — Intellectual Property
All elements of the platform (source code, interfaces, logos, trademarks, databases, algorithms) are protected by intellectual property rights and are the exclusive property of Afrilink Digital Group SAS or used under licence. Any reproduction, distribution, or adaptation without prior written authorisation constitutes an infringement punishable under Articles L.335-2 and L.713-2 of the French Intellectual Property Code.
Art. 8 — Personal Data
The processing of personal data is governed by the Privacy Policy available on this site, which forms an integral part of these Terms of Use. The platform is compliant with the GDPR (Regulation (EU) 2016/679).
Art. 9 — Governing Law & Jurisdiction
These Terms of Use are governed exclusively by French law. In the event of a dispute, the parties shall seek an amicable resolution before resorting to legal proceedings. Failing agreement within 30 days, the commercial courts of the jurisdiction of Afrilink Digital Group's registered office shall have sole competence.
